The order you place with ORACLES.EU.COM will be subject to these Terms & Conditions – please read them carefully.
These Terms and Conditions are published by Oracle Cigarettes (“we”, “us”) a company registered in England and Wales (number 06864126).
Oracle Cigarettes declines all responsibility and may not be held liable in any case:
- for any interruption in provision of the Site or services accessible via the Site,
- for the occurrence of bugs, viruses and similar technical issues adversely affecting your ability to access this Site,
- for any inaccuracy, isolated and unforeseen error or omission relating to information available on the Site,
- for any damage resulting from a fraudulent intrusion by a third party that has led to a modification of the information provided on the Site,
- and more generally, for any direct or indirect or consequential harm, loss or damage, whatever the cause, origin, nature or consequences, which may occur as a result of any type of access to the Site or any inability to access it or the credit given to any piece of information coming directly or indirectly from the latter. |

- (each referred to as a “Request” in these Terms and Conditions).
A Request is an offer by you which, if accepted by us, becomes a legally binding agreement.
2.2 You are responsible for accurately specifying the terms of your Request. If, due to any variation in price of the Goods, the price of the Goods is different from that set out in your Request, we will discuss this with you prior to processing your order.
2.3 Online and mail order Goods are sold for personal use only and not for resale.
3.1 We take care to ensure that all product information and pricing in respect of the Goods featured in ORACLE.EU.COM and magazines are accurate. However, our Goods are continually updated and the images, specifications and prices may change. The representation of colors in the magazine and particularly online may vary from the actual colors. Goods shown may not be to scale and we are unable to guarantee their size. Products are propped for size and to show usage – unless specified, props are not included.
3.2 All Goods are subject to availability. In the event that your chosen Goods are not available we will suspend your Request and notify you accordingly. If we have already processed your payment, you can choose either (1) a full refund or (2) to receive the goods when they become available again (if applicable).
We have made reasonable endeavors to ensure the information is correct at the time of writing. Any typographical, clerical or other error or omission on ORACLES.EU.COMand/ or magazines shall be subject to correction without any liability on our part. |
5.1 The price of the Goods will be the price set out in ORACLES.EU.COM and/ or magazine excluding delivery charges.
5.2 We reserve the right to change the prices quoted in the ORACLES.EU.COM and/ or magazine at any time. Where used, ‘RRP’ means the recommended retail price on the high street in the UK.
5.3 Prices for Goods in ORACLES.EU.COM and/ or magazines are shown in £sterling (GBP) and, where applicable, are inclusive of UK VAT. You will be liable for any import duties and local sales taxes that may be levied in the country of delivery.
5.4 Card payments will appear on your payment card statement as “Oracle Cigarettes”. Transactions will be effected in £sterling (GBP), € Euros or $US dollars and may be converted by your card issuer into your home currency.

By presenting us with a payment card or details thereof, you confirm that (i) your use of the card to pay for Goods specified in the Request is authorized and (ii) that you authorize us to take payment of the full price of the Goods and all other amounts due such as delivery charges. We will confirm such other amounts with you by telephone or email prior to taking payment. |
7.1 We deliver to most parts of the world. For Requests placed online.
7.2 Deliveries outside the UK will typically carry an additional charge, which will be confirmed at checkout.
7.3 From receipt of your Request, we aim to dispatch Goods within 5 working days. Please allow up to 21 days from our receipt of your Request for delivery of the Goods.
7.4 Goods ordered together may be dispatched separately (at no extra cost to you).
7.5 Title to and risk in the Goods shall pass to you on delivery.
7.6 We may decline a Request where we believe the delivery address is not secure.
7.7 In these Terms and Conditions, the UK means England, Northern Ireland, Scotland, Wales, Isle of Man, Channel Islands and BFPO addresses. |
Unwanted goods
8.1 Subject to clause 8.4, we will refund or exchange any unwanted Goods within 14 days of your receipt of them provided that you notify us of your intention within that time.
Faulty goods
8.2 Subject to clause 8.4, if when you receive them Goods are faulty or are not as described, we will offer you:
8.2.1 if you notify us within 14 days of receipt: the choice between a full refund, repair or replacement; or
8.2.2 if you notify us between 14 days and 1 months following receipt: either a repair or a replacement.
8.3 Please note that goods shall not be considered faulty where a defect is due to wear and tear or willful damage by or negligence of anyone other than us, our contractors or agents.
For all returns and cancellations
8.4 For returns and/or cancellations under clauses 8.1 to 8.3, we must receive the Goods back from you:
(a) within 7 days of your notification;
(b) with the original receipt or delivery note;
(c) with a covering letter (specifying your order number, order date, delivery address, contact details, details of the fault (if any) and whether you require a refund/exchange/repair as applicable);
and, in the case of returns under 8.1, the Goods must be:
(d) in an unused condition with their original packaging intact.
8.6 We are not responsible for returned Goods that are lost or damaged in transit. Proof of postage is not proof of receipt by/delivery to us. You should take reasonable care to ensure that the Goods returned are not damaged in transit and if appropriate arrange suitable insurance.
8.7 We will not refund you costs of delivery of Goods back to us other than in the case of:
- Goods you return to us under clause 8.1 where you have not complied with the conditions set out at clause 8.4
8.8 Our returns & cancellations policy is based on your statutory rights.

9.1 Subject to clause 9.2, we shall not be liable for any loss or damage (in contract, negligence or otherwise) where the loss or damage is an indirect result of any breach of a legal duty of care owed to you by us.
9.2 We shall have the right to suspend or cancel our obligations (without liability to you) in whole or in part if we are delayed or prevented from carrying on our business or any of our obligations under these Terms and Conditions due to any circumstance beyond our reasonable control.
9.3 Nothing in these Terms and Conditions shall be deemed to have given you a license or any other rights to use the intellectual property rights owned by or licensed to us, including those created by us in the course of performance of our obligations.
9.4 No third party (excluding any member of the Oracle Cigarette group, who shall have such benefit and right) shall have the benefit of or the right to enforce these Terms and Conditions under the Contracts (Rights of Third Parties) Act 1999 or otherwise.
9.5 These Terms and Conditions set out the entire agreement and understanding between you and us in connection with the sale of the Goods. You agree that you have not entered into this agreement in reliance on any representation made by or on behalf of Oracle Cigarettes except in so far as contained in these Terms and Conditions.
9.6 Nothing in these Terms and Conditions excludes or limits our liability for fraudulent misrepresentation or for death or personal injury caused by our negligence. |
These Terms and Conditions shall be subject to English law and the parties hereby submit to the exclusive jurisdiction of English courts. |
If you place an order with ORACLES.EU.COM, we will record your personal details. Your data will be used principally to provide you with the goods and/or services you have purchased. We retain the data you provide from time to time, including data we collect when you place an order or use our products and services. Your data may be used for the following purposes: accounting, billing and audit, credit or other payment card verification, security, administrative and legal purposes, systems testing, maintenance and development. For these purposes we may disclose your data to any of the following: other companies in the Oracle Cigarettes group, other companies involved in providing you with the goods and/or services you have ordered (including our payment gateway service provider, logistics providers and customer service agents), data processing companies, our technology suppliers, government and enforcement agencies and credit and charge card companies.
